Shall Ordinance No. 02-2026 be approved to create the DeBary Land Bank Program, authorize the levy and collection of ad valorem taxes between 0.20 and 0.50 mill per annum for a period not beyond September 30, 2039, for the purpose of financing land acquisitions and other related expenses for the conservation, control of overdevelopment, preservation and non-residential redevelopment under the DeBary Land Bank Program?

Adopts a Charter Preamble stating purposes of municipal government, including public health, safety, environmental stewardship, home rule authority, ethical governance, fiscal management, program evaluation, protection of City governmental interests and Charter authority, annual State of the City reporting, and stormwater policy recognition.

Should the City adopt the revised Charter Preamble?

Amends the Charter to increase the number of City Council members from four to six, plus the Mayor, when the City’s official population exceeds 37,000, by establishing two additional voting districts with one Council member elected from each new district.

The City Charter currently provides a vacancy in elected office is filled at the next regularly scheduled election unless said election is more than one year in the future, in which case a special election is called to fill the vacancy. This amendment requires the City Commission to appoint a qualified resident within 30 days of such a vacancy to serve on a temporary basis until the next election.

Shall the City Charter be amended to require the temporary filling of a vacancy in an elected office by appointment by the City Commission to serve on a temporary basis until the next election?

The City Charter only requires the City Commission to have a Charter Review Committee every ten (10) years. The proposed amendment requires the City Commission to create the Charter Review Committee by September 30th of the year before the 10-year anniversary for the Charter Review, requires Committee members to be registered voters of the City and the Mayor’s appointment shall serve as Chairman of the Committee.

The City Charter requires fluoride to be added to the City’s public water supply. State law was recently amended to not allow the city to add fluoride to the City’s potable water supply. The proposed amendment removes the requirement that the city add fluoride to the City’s potable water supply so that the City’s Charter will be compliant with the current State law.

Should the City’s Charter be amended to remove the requirement that the city add fluoride to the city public water supply?

A Charter Review Committee consisting of residents’ proposed updates the Town Charter to clarify residency requirements to qualify for elected office and the election process; provided for filling of vacancies; created a forfeiture of office procedure for elected officials who engage in certain prohibited conduct; and to make the Charter consistent with State law and with the Town’s practices and procedures.

Shall the Town Charter be amended to update the provisions of the Charter?

The City’s Charter currently requires each prospective candidate for the Office of Mayor or Council Member to reside within the City of Port Orange for at least 12 months. Shall the City of Port Orange adopt revised Charter Section 5.02, to specify that this 12 month residence requirement must be both continuous in nature and immediately preceding the qualification period?

Shall the City of Port Orange adopt revised Charter Section 5.02, to require all candidates for the Office of Mayor or Council Member to submit a sworn affidavit containing an affirmation of compliance with the Charter’s residence requirement and disclosing the candidate’s current and former residence addresses along with requiring the submission of proof of residence (i.e. driver's license, property tax receipt, homestead exemption, utility bill or lease agreement)?

Shall the City of Port Orange adopt revised Charter Section 5.02, to designate the City Council as the responsible body for deciding all disputes related to qualifications or elections, subject to review by a court of competent jurisdiction?
